Controller

Two independent lawyers practise at Domplatz 16 in cooperation. They do not form a law firm partnership.

For the operation of this website, for the contact form and for the request for a call, both are joint controllers under Article 26 GDPR.

You may exercise your rights against either of them. We will make the essence of the arrangement available to you on request.

For an instruction, by contrast, the lawyer you have instructed is the sole controller. He is named in the power of attorney.

No data protection officer has been appointed. The conditions of Article 37 GDPR are not met.

What this website processes

This website works without cookies. No analytics services, no advertising networks, no social media components and no external fonts are embedded. No consent is therefore requested.

When a page is called up, the web server processes technically necessary data in a log file: IP address, date and time, the address called up, the volume of data transferred, browser type and operating system.

The legal basis is the legitimate interest in the secure and stable operation of the website under Article 6 (1) (f) GDPR.

These log files are kept by our hosting provider, World4You Internet Services GmbH. We do not evaluate them. They are deleted after 90 days at the latest.

Contact form and request for a call

If you write to us using the contact form, we process your name, your email address, where given your telephone number, and the content of your message.

Through the form on the home page with which you ask us to call, we process only your name and your telephone number. We use both solely in order to call you.

What follows applies to both forms alike.

The legal basis is Article 6 (1) (b) GDPR where the enquiry serves to prepare an instruction, otherwise Article 6 (1) (f) GDPR.

The data are used solely to deal with your enquiry. If the enquiry leads to an instruction, the professional retention obligations apply. If it does not, we delete the enquiry after six months at the latest.

Please do not transmit special categories of personal data under Article 9 GDPR through the form, in particular no health data. For those, post or a personal meeting is the appropriate route.

Map

On the contact page you will find a link to a map service. The map is not embedded in the page. Only when you click the link do you leave this website, and the map provider's privacy terms then apply.

Client intake form

Through the form at domplatz16.mandanten.legal you can send us your details and documents in encrypted form before the first appointment. The form is not part of this website.

It works in one direction only. There is no login with a username and password, and you can neither view your file there nor access the data you have sent afterwards.

The form is operated by ADVOKAT Unternehmensberatung GREITER & GREITER GmbH, Andreas-Hofer-Straße 39b, 6020 Innsbruck, acting as our processor under a contract pursuant to Article 28 GDPR.

Processing takes place entirely within the European Union; the data are held on servers in Austria. ADVOKAT uses a single sub-processor, ANEXIA Internetdienstleistungs GmbH in Klagenfurt, which provides the server architecture and has no access to the data.

The controller for the data you send is the lawyer you approach. Your details form part of the instruction.

Processing within an instruction

The controller is the lawyer you have instructed.

Within an instruction we process the data required for the representation. The legal basis is Article 6 (1) (b) and (c) GDPR in conjunction with the Rechtsanwaltsordnung. Health data and other special categories are processed for the establishment, exercise or defence of legal claims under Article 9 (2) (f) GDPR.

Disclosure takes place only in so far as it is necessary for the representation — for example to courts, authorities, the opposing party or experts — or in so far as we are required by law to do so.

We are bound by professional secrecy. That obligation takes precedence over any third party's interest in obtaining information.

Files are kept for ten years after the end of the instruction and are then destroyed. The periods that govern this are those of section 12 RAO, section 132 BAO and the limitation periods for claims arising from the instruction.

No automated decision-making, including profiling, within the meaning of Article 22 GDPR takes place.

On being instructed you will receive the full information under Articles 13 and 14 GDPR as an annex to the power of attorney.

Your rights

You have the right of access, rectification, erasure, restriction of processing, data portability and objection. Please write to datenschutz@domplatz16.at.

These rights may be restricted by a lawyer's duty of professional secrecy and by statutory retention obligations.

If you consider that the processing of your data infringes the GDPR, you may lodge a complaint with the Austrian Data Protection Authority: Barichgasse 40-42, 1030 Vienna, dsb.gv.at.

Hosting

The website is hosted by World4You Internet Services GmbH, Wolfgang-Pauli-Straße 2, 4020 Linz, Austria, acting as our processor under a contract pursuant to Article 28 GDPR. Its servers are located exclusively within the European Union.

The contact form and the request for a call run through the same provider. Your message is forwarded from there to our mailboxes.
